Clarifications can be raised once or twice. But if he is mumbling like that you can reflect that in your report. If it is a real scenario the counsel for either party will surely intervene. Unclear depositions can be useful to one party and damaging to the other. The older guy tried to usurp authority. He just have to report what can be reported and refer to the rest as unintelligible. Anyhow it's funny how they handle the scene.

The procedure that I do is this: I can't understand. Repeat. I can't understand. Repeat. Keep saying that until you understand. If the attorney gets upset with you, tell him he is free to call any number of other agencies and have a nice day. I've been reporting too long to have to put up with bs. Don't do it either.

Wow, that reminds me of MANY of the depositions I have sat through. I'm a court reporter and I can honestly say I've had to stop people MANY times and say I simply couldn't understand the witness, just like the male reporter in this video. Candid Camera? Heck, this is a day in the life of a court reporter!
